Terms of Service
Effective date: TODO: YYYY-MM-DD
1. Who we are
TikFactory is a service that turns story ideas into narrated, illustrated videos. It is run by TODO: Legal entity name, TODO: Registered address("we", "us"). These terms are an agreement between you and us. By creating an account or buying credits you accept them. Contact us atTODO@example.com.
2. Your account
- You must be at least 18 years old to create an account and buy credits.
- Sign-in is provided by WorkOS, our authentication provider. Keep access to your sign-in method safe: orders made from your account count as yours.
- One account per person. Do not create several accounts to get more free story ideas.
3. Credits and payments
- You pay for videos with prepaid credits. Credits are sold in packs through Polar, which acts as the merchant of record: Polar takes the payment, charges the applicable taxes, issues the receipt and handles payment questions. Polar's own terms also apply to the purchase.
- Each order shows its price in credits before you confirm it. The credits are taken from your balance when you order. Extra batches of story ideas can also cost credits; the price is shown before you buy.
- Credits have no cash value, cannot be transferred to another account and can be exchanged for money only as described in theRefund Policy. Credits do not expire while your account is open.
- We may change the price of videos in credits for future orders. This does not change the number of credits you already have.
4. Free story ideas
New accounts get a number of free batches of story ideas. We may change how many, and we may stop free ideas for accounts that abuse them.
5. Orders and delivery
- When you order, production starts automatically. Production times on the site are typical times, not guarantees.
- The finished video, its cover and the post texts are delivered as files in your account.
- If a video cannot be made, its credits are returned to your balance automatically. See the Refund Policy.
6. AI-generated content
Stories, art, voices, sound and music are generated automatically with third-party AI services. Results can contain mistakes, including in stories based on real events, and can resemble other works by chance. Fiction is invented: any resemblance to real people is unintended. Review every video before you publish it. We do not promise that a platform will accept, recommend or monetize a video.
7. What you give us
You may add your own plot and choices. You must have the right to use what you submit, and it must not include other people's personal data or break the law. You allow us to use it, and to send it to our AI providers, to make your videos.
8. Your videos
TODO: confirm the content rights policy. Suggested: You may publish the videos you order on any platform, including monetized channels, edit them and use them commercially. No credit to us is needed. Label them as AI-generated where a platform asks you to. You may not resell them as stock footage.
We keep copies of your videos and texts to deliver them to you and to run the service.
9. Acceptable use
Do not use TikFactory to:
- make content that is illegal, harasses or defames anyone, or targets a real private person;
- pass a video off as real footage of real events or people in a way that deceives viewers;
- break the rules of the platforms where you publish, including their rules on labeling AI content;
- attack, overload or reverse engineer the service, or resell access to it.
We may refuse an order, or suspend an account, that breaks these rules.
10. Changes and availability
We improve the service over time and may change its features, quality tiers and AI providers. We try to keep it available, but it may be interrupted for maintenance or by problems with our providers.
11. Closing your account
You can ask us to close your account at any time by writing to TODO@example.com. We may close an account that seriously or repeatedly breaks these terms. If we close your account for any other reason, we refund the credits you paid for and did not use.
12. Liability
The service is provided "as is". To the extent the law allows, we are not liable for indirect or consequential losses, such as lost profits or lost audience, and our total liability is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits rights you have as a consumer that cannot be limited by contract.
13. Governing law
These terms are governed by TODO: the laws of <country or state>, and disputes go to the courts of <place>. If you are a consumer, the mandatory consumer protection laws of your country still apply.
14. Changes to these terms
We may update these terms. We will post the new version here with its effective date and, for important changes, tell you by email before they apply. If you keep using the service after that, the new terms apply.
